Penalties for Second DUI/OUI Conviction in Massachusetts
Facing a second DUI/OUI offense in Massachusetts carries substantial penalties, reflecting the state's stringent stance on repeated violations. Under Massachusetts General Laws, convicted second offense OUI offenders face various penalties, including fines and imprisonment.
Offenders previously convicted may face fines ranging from $600 to $10,000. Imprisonment terms stipulate a minimum of sixty (60) days to a maximum of two and a half (2 1/2) years.
Note: the law requires convicted parties to serve at least thirty (30) days of the sentence without eligibility for reduction, suspension, probation, parole, or furlough. Nor can sentences be decreased for good behavior before this period is served.
