Penalties for Second DUI/OUI Conviction in Massachusetts

Facing a second DUI/OUI offense in Massachusetts carries substantial penalties, reflecting the state's stringent stance on repeated violations. Under Massachusetts General Laws, convicted second offense OUI offenders face various penalties, including fines and imprisonment.

Offenders previously convicted may face fines ranging from $600 to $10,000. Imprisonment terms stipulate a minimum of sixty (60) days to a maximum of two and a half (2 1/2) years.

Note: the law requires convicted parties to serve at least thirty (30) days of the sentence without eligibility for reduction, suspension, probation, parole, or furlough. Nor can sentences be decreased for good behavior before this period is served.

When a judge does not feel jail time is appropriate, that jail time MAY be suspended and offenders must complete a 14-day inpatient treatment program. If your first offense was more than ten years prior to the new arrest, a potential to decrease the punishment is available,

Other penalties that you may face due to a second-offense DUI charge include:

  • License suspensions
  • Mandatory enrollment in an alcohol education program
  • Ignition interlock device (IID) installation
  • Probation
